Punishments Under Bharatiya Nyaya Sanhita (BNS) Explained

πΉ Section 4 β Types of Punishments
A person can get these punishments:
a. Death penalty
b. Life imprisonment
c. Imprisonment
- Rigorous β with hard labour (like physical work)
- Simple β no hard labour
e. Fine (money penalty)
f. Community service
π Example:
If someone commits theft β court can give jail + fine.
πΉ Section 5 β Commutation of Sentence
Government can change punishment to a lighter one without asking the criminal.
a. Central Govt β for national matters / death penalty
b. State Govt β for state matters
π Example:
Death penalty β changed to life imprisonment.
πΉ Section 6 β Life Imprisonment Calculation
For calculation purposes:
π Life imprisonment = 20 years (assumed)
π Example:
If law says β1/2 of life imprisonmentβ β it means 10 years.
πΉ Section 7 β Type of Imprisonment
Court decides:

Fully rigorous

Fully simple

Mixed (some part rigorous + some simple)
π Example:
10 years jail β 5 years hard labour + 5 years simple.
πΉ Section 8 β Fine Rules
1. No limit on fine (but should not be excessive)
If fine is not paid:
Court can give extra imprisonment
π Example:
βΉ10,000 fine β not paid β extra jail.
Limit on extra jail (default of fine)

Max = 1/4 of maximum punishment
π Example:
Max punishment = 4 years
β Default jail = max 1 year
If only fine (no jail punishment)

Important Rules

Jail ends once fine is paid

Fine can be collected within 6 years

Even after death β property can be used to recover fine
πΉ Section 9 β One Act, One Punishment
If one act has multiple parts:
π Person gets only one punishment, not multiple.
π Example:
A hits Z 50 times β still one punishment, not 50.
BUT π
π If different victims:
π Example:
A hits Z and also hits Y
β A gets two punishments
πΉ Section 10 β Doubt Between Offences
If court is unsure which crime is committed:
π Give punishment for less serious offence
π Example:
Crime could be theft OR cheating
β court gives punishment for lighter one.
πΉ Section 11 β Solitary Confinement
Court can give isolation (alone jail) but limited:

If person commits serious crime again:
